Terms and Conditions

Terms and Conditions of using the free of charge "Kot-Spot" Service
(valid from 25.05.2018)

§ 1. Definitions:
Hotspot – wired or wireless access devices which cover an area where it is possible to connect and access the “Kot-Spot” Service. 
“Kot-Spot” Service – a Platform provided by the Service Provider in the Area of Operation allowing for access to the internet and other network services 
Area of Operation – the place where it is possible to use the “Kot-Spot” Service on the basis of a contract concluded between the Entity Managing that place and the Service Provider 
User – any natural or legal person who logged into the “Kot-Spot” Service.
Terminal – a portable device of the User, connected to the Hotspot (laptop, mobile phone, tablet, etc.)
LOGIN– mobile telephone number which was provided by the User during registration to the “Kot-Spot” Service 
Voucher – a document issued by the Manager of the Area of Operation with an access code necessary for completing the first login procedure, if the Manager of the Area of Operation requires its possession. 
Service Provider –  entity providing the service  INVICOM Sp. z o.o. with the seat in Poland, Ustroń ul. 3 Maja 44, post code: 43-450 entered into the National Court Register with the following number: 0000347399, holder of TAX CODE.: 5482608799 , email: kontakt@kotspot.pl
Managing Entity – natural or legal person, or a person with legal power, holding the legal title to the Area of Operation (office, hotel, bar, etc.)
Terms and Conditions – Terms and Conditions for using the free “Kot-Spot” Service are available free of charge on the registration site, enabling the User to read them

§ 2. General Provisions
1. These Terms and Conditions specify the principles and conditions of using the “Kot-Spot” Service. 
2. A service „KOT-SPOT”   ensuring access to an internet connection or other network services via Hotspot , ensuring Authentication, Marketing, Statistical and other features.   

§ 3. Use of the “Kot-Spot” Service
1. The Service Provider enables the Users to use the “Kot-Spot” Service in order to connect to the internet and to use other network services
1) The “Kot-Spot” Service is provided free of charge, only in the Area of Operation. 
2) Access to the “Kot-Spot” Service is possible only after logging in. Logging in to the “Kot-Spot” Service is free of charge.
2. To use the “Kot-Spot” Service it is necessary to connect a given Terminal with Wi-Fi network available in a given area (SSID – the name of the network should have the word "KOT-SPOT" in the name, in the absence of the so-called network and the problem of its identification, please contact the Managing Entity ). 
In the case of service availability via a cable connection, connect the terminal device in one of the places indicated for this purpose in the Area of Operation. 
No additional Terminal configuration is required.
In the case of problems with using the “Kot-Spot” Service, please contact the Managing Entity (facility personnel).
3. After activating the internet or other network services in the Area of Operation using the “Kot-Spot” Service, you will be transferred to the log in website – Free SMS Authentication.  The User will obtain access to the Service after logging in and completing the Authentication procedure, according to the appearing messages.
A non-registered person who wants to obtain access to the “Kot-Spot” Service must fill out the required fields and grant a consent for processing their personal data by the Service Provider for the purpose of providing the service as well as for statistical and marketing purposes. Registration is free. 
To register, User must have an active mobile phone number that accepts SMS text messages. .
4. When completing registration, the User confirms that they have read the Terms and Conditions which will be provided to them by means of a hyperlink, so that the User can read the Terms and Conditions before completing registration. 
5. The SMS password to the “Kot-Spot” Service is valid for 30 calendar days. The Service Provider is authorized to deactivate the password prior to the lapse of the above period for safety purposes or in the case of a suspicion that the Terms and Conditions have been violated. 
6. If the User revokes their consent for processing information disclosed during registration, the User ID (LOGIN) will be deactivated and the User will no longer be able to use the “Kot-Spot” Service. In order to continue to use the Service, the User will have to reregister. For reregistration, the same telephone number can be used again.
7. For logging in in the case where the Manager of the Area of Operation decided that such is required, a Voucher will be necessary.  A person who wants to use the “Kot-Spot” Service should refer to the Manager of the Area of Operation to obtain a Voucher. Issuing a Voucher does not involve any additional fees to be incurred by the User. 
8. Access to the “Kot-Spot” Service is possible 24 hours a day, 7 days a week, with reservation of § 4.

§ 4. Limitations
1. The Service Provider is authorized to impose limitations for the duration of the connection, capacity, limit of data transfer and other transmission parameters, limiting and blocking access to selected content and services online, registering and supervising information or data in order to ensure safety, compliance with the law and managing the “Kot-Spot” Service.
2. The Service Provider reserves the right to limit and block access to selected content online. The Service Provider reserves the right to refusing access or blocking access to the “Kot-Spot” Service to a User towards which it is proven that any of the prohibitions specified herein are violated. 
3. The Service Provider informs that the activeness of Users using the Service is monitored. 
4. The Service Provider reserves the right to interruptions in the operation of the “Kot-Spot” Service due to maintenance works and other unexpected circumstances. The User will not be entitled to any claims due to temporary or permanent lack of access to the “Kot-Spot” Service resulting from shutting down or technical problems with the Hotspot device. 
5. The Service Provider does not guarantee the following: 
1) Permanent capacity of the connection and other parameters,
2) Uninterrupted proper functioning of the “Kot-Spot” Service,
3) Access to all network, application and internet services,
4) Radio coverage in indicated areas.
6. The parameters of the “Kot-Spot” Service, such as session duration, internet speed limits and data limits are indicated independently by each Manager of the Area of Operation.

§ 5. User Responsibility
1. The use of the “Kot-Spot” Service takes place at sole risk and responsibility of the User.
2. The User uses the “Kot-Spot” Service on condition of reading and accepting these Terms and Conditions. 
3. It is prohibited for a User to user the “Kot-Spot” Service for any activities violating the applicable laws. Particularly, the User cannot: 
1) Share or download from the internet: materials protected by copyright (software, films, music, etc.), pornographic, racist or fascist content, etc., 
2) Send or share content which may violate anyone’s personal rights, send advertisement content unwanted by recipients (spam),
3) Distribute computer viruses and other software which may damage software or data of other internet users, acquire unauthorized access to IT system resources being in possession of other internet users,
4) Interfere with or test security features used in the “Kot-Spot” Service.
4. The following activities of the User are prohibited:
1) Any activities which may be considered dangerous for the functioning of the “Kot-Spot” Service,
2) Activating network services for other internet users,
3) Sharing the internet connection with other parties using telecommunications devices such as Access Points, routers, etc.,
4) Sharing your User ID (LOGIN) or access password with third parties, or the Voucher, if received from the Managing Entity. 
5. The user will counteract, by means of its activity or lack of activity, the possibility of third parties accessing the User ID (LOGIN) and/or the access password or the Voucher, if the latter was issued. 
6. If the User fails to follow these Terms and Conditions or uses the “Kot-Spot” Service against its purpose, the Service Provider will be entitled to block the User’s Login, which does not exclude liability for damages of the User towards the Service Provider, other Users or entities, as well as criminal liability of such a User. 
7. The User is obliged to act with due diligence when securing the Terminal against unauthorized access and other ICT-related risks (viruses, spam, etc.).
8. The User will be solely responsible for the method in which they use the “Kot-Spot” Service including the content of the messages, taking into account criminal liability for activities which are against the law.

§ 6. Personal Data
1. Personal Data of Users being natural persons (including natural persons conducting a one-man business) will be processed by the Service Provider as the administrator of personal data for the purpose of providing access to the “Kot-Spot” Service, and in the case of obtaining an explicit consent of the User, also for statistical or marketing purposes. On the basis of the consent given, personal data may be made available to other entities for purposes indicated therein.

2. The processing of the collected data is carried out in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repeal of Directive 95 / 46 / EC, acts of 10 May 2018 on the protection of personal data and the Act of 18 July 2002 on the provision of electronic services.
3. Providing personal data by User  is voluntary. The data subject has the right to withdraw his consent at any time. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.
4. If the "KOT-SPOT" Service is registered by a person who is under 16 years of age, the processing of personal data of that person is possible if the person being its legal guardian consented to it.
5. Personal data will be processed until the User withdraws consent to their processing
6. The person whose personal data is processed has the right to request the administrator to access his personal data, rectify them, remove or limit the processing or the right to object to the processing, as well as the right to transfer data. In addition, this person has the right to lodge a complaint to the President of the Office for the Protection of Personal Data - Prezesa Urzędu Ochrony Danych Osobowych).
7. A person who requests the deletion of his personal data may send an SMS message from the telephone number used for registration, to the number 4450 with the following text: "OLYMPIC.REGZYGNACJA". The participant bears the cost of sending an SMS message at the rate of its telecommunications operator. The SMS sent is not a Premium message type. The request to delete data may also be sent in another way with an indication of the User ID enabling its verification.
8. Withdrawing by the User consent to the processing of his personal data is tantamount to the loss of the possibility of using the "KOT-SPOT" Service.
9. Confidential information about Users, including Users' personal data are protected by the Administrator before they are made available to unauthorized persons, as well as other cases of their disclosure or loss and against destruction or unauthorized modification of indicated data and information through the use of appropriate technical and organizational security.

§ 7. Trade offers

1. The User may, in connection with his / her consent, receive information about promotional actions organized by the Managing Entity. The message will indicate its terms and conditions and the reference to the promotion regulations.
2. If the promotional action requires registration to the Manager's loyalty program, the "Kot-Spot" Service User can use it without the need of additional registration to the program.

§ 8. Final Provisions
1. The “Kot-Spot” Service User can submit technical problems by e-mail to pomoc@kotspot.pl 
2. In matters not regulated herein the Civil Code will apply. 
3. The Service Provider is authorized to introduce changes to these Terms and Conditions at any point.
4. The content of the Rules, its layout and all the provisions contained therein are of the nature of a work within the meaning of art. 1 of the Act of February 4, 1994 on copyright and related rights. 1994 No. 24 item 83and are protected by the rights of their creator against any interference, in particular copying, duplication, tampering and any other violation of their integrity as a whole, under pain of indemnity
5. The User will not be entitled to any claims due to changing these Terms and Conditions.
